The NYC DOT and legislators have even pushed to lower the legal blood alcohol limit while driving to 0.05. Currently, New York’s BAC limit for a DWI is .08, but you can get a DWAI, which is driving while ability impaired by alcohol, if your BAC is more than .05 but less than .07.

The legal limit for BAC for drivers 21 and under is .02, while commercial motor vehicle drivers must not drive with a BAC over .04.
